Liability Disclaimer & Participation Terms

A legal disclaimer

(Website Terms – Binding Upon Entry & Participation)

By entering any Craft For Team premises, booking a workshop, or participating in any activity (“Activity”), you (“Participant”) agree to be legally bound by the following terms. Participation constitutes full acceptance of this Liability Waiver and Release (“Agreement”). No physical signature is required.

 

1. Voluntary Participation & Full Assumption of Risk

Participation in Craft For Team workshops is entirely voluntary.
Activities may include—but are not limited to—use of tools, sharp objects, tufting equipment, adhesives, hot tools, electrical devices, paints, resins, moss, glues, machinery, and other craft materials.

Participant acknowledges that these activities involve inherent and unavoidable risks, including but not limited to:

  • Cuts, punctures, burns, abrasions

  • Eye or skin irritation

  • Allergic reactions to materials, dust, moss, fragrances, or chemicals

  • Equipment malfunction

  • Tripping hazards or falls

  • Physical or psychological injury

  • Damage to personal property

  • Serious bodily harm or other unforeseen hazards

Participant expressly and voluntarily assumes all such risks, both known and unknown, whether caused by themselves, other participants, equipment, or environmental conditions.

 

2. Release of Liability & Waiver of Claims

To the fullest extent allowed by California law, Participant hereby releases, waives, discharges, and agrees not to sue Craft For Team; its owners, instructors, employees, contractors, agents, representatives, affiliates, successors, and assigns (“Releasees”) for:

  • Any injury, illness, accident, property damage, economic loss, emotional distress, or harm

  • Arising from or related to participation in the Activity

  • Whether caused by ordinary negligence, actions of other participants, or conditions of the premises

This release covers all claims, demands, causes of action, damages, costs, and liabilities whatsoever, whether in contract, tort, equity, or otherwise.

Participant agrees this waiver also applies to:

  • Negligent supervision

  • Negligent instruction

  • Negligent maintenance of equipment or facilities

  • Negligent hiring or training

Participant understands and agrees that by participating, they give up the right to bring any legal action related to these risks.

 

3. Medical Authorization & Responsibility

In the event of illness, accident, or emergency:

  • Craft For Team may provide or arrange basic first aid or emergency services but is not obligated to do so.

  • Participant authorizes emergency medical treatment if deemed necessary.

  • All medical expenses, treatment costs, and related financial responsibilities belong solely to the Participant.

Participant is advised to maintain their own health insurance.

 

4. Indemnification / Hold Harmless Agreement

Participant agrees to indemnify, defend, and hold harmless Releasees from any claim, lawsuit, damage, or liability brought by:

  • Participant

  • A third party

  • Minors accompanying Participant

  • Family members or guests

This includes attorney fees, settlement costs, and all related expenses arising directly or indirectly from participation in the Activity.

 

5. Damage to Studio or Equipment

Participant agrees to be financially responsible for:

  • Any damage caused by their negligence, misuse, recklessness, or failure to follow instructions

  • Replacement or repair costs for tools, furniture, equipment, or studio fixtures

 

6. Personal Property Disclaimer

Craft For Team is not responsible for:

  • Lost, stolen, or damaged personal items

  • Belongings left unattended or left behind

Participant is solely responsible for securing personal property.

 

7. Minors

Minors under 18 may only participate with a parent/guardian who:

  • Accepts full legal responsibility

  • Assumes all risks on behalf of the minor

  • Agrees to all terms of this Agreement

 

8. No Warranties

Craft For Team makes no guarantees or warranties of any kind, express or implied, regarding:

  • Safety

  • Outcomes of projects

  • Condition or performance of tools/materials

  • Suitability of the activity for Participant’s health

Participation is “as is” and at Participant’s own risk.

 

9. Choice of Law & Binding Arbitration

This Agreement is governed exclusively by the laws of the State of California.

Participant agrees that:

  • Any dispute, claim, or controversy arising out of participation shall be resolved through binding arbitration in San Francisco County, California.

  • Participant waives the right to a jury trial.

  • Arbitration shall be the sole and exclusive method of dispute resolution.

 

10. Severability

If any portion of this Agreement is found invalid or unenforceable, the remaining provisions shall remain fully enforceable to the maximum extent permitted by law.

 

11. Acceptance Without Signature

By entering the premises, booking an event, or participating in any Activity, the Participant acknowledges:

  • They have read, understood, and agreed to all terms

  • They assume all risks

  • They release Craft For Team from all liability

  • This Agreement is immediately binding, without the need for a signature
